These terms and conditions of sale ("T&Cs") are offered by:

Hereinafter "FORRIDER".
These T&Cs govern:
They apply to consumer, non-professional and professional clients. Rules reserved for consumers apply to professionals only where the law so provides.
The "Client" means any person ordering a product or a service. The "Consumer" means a natural person acting for purposes outside their professional activity.
The characteristics, prices, timeframes, licences and specific conditions shown on the product sheet, offer, quote or order summary supplement these T&Cs. In case of conflict, the specific conditions expressly accepted prevail.
The Client acknowledges having received the necessary information before ordering and having accepted the T&Cs. Online, acceptance is evidenced by an un-pre-ticked box.
The Client declares that they have the required legal capacity. If ordering for a third party or a legal entity, they warrant that they are authorised to bind it.
The Client provides accurate and complete information, in particular their identity, contact details, delivery address and the elements needed for the service. FORRIDER is not liable for any delay or impossibility of performance caused by incorrect or incomplete information.
The product sheet or quote sets out the essential characteristics: model, shape, dimensions, materials, colours, options, care and any customisation.
Photographs and renderings are presented with care, but colours may vary depending on screens, lighting and the normal variations of materials. Such differences do not limit the Consumer's rights in the event of a lack of conformity.
The Client checks that the model and dimensions suit their equipment and intended use. FORRIDER's advice does not replace a professional's opinion where fitting the equipment may affect the horse's comfort or health.
The offer or quote specifies the date, place, indicative duration, deliverables, options, travel costs, delivery timeframe, licence and price.
Unless otherwise agreed, the service includes shooting, editorial selection by FORRIDER, processing or editing in line with its artistic universe, and delivery of the planned items. The number of shots taken is not guaranteed. Raw files, rushes, working files and edit projects are not delivered, save by written agreement and specific pricing.
The Client acknowledges being aware of FORRIDER's style. Choices of framing, lighting, colour grading, selection, pace, music and editing are a matter of its artistic judgement, within the agreed characteristics.
For an online order, the Client selects the products or services, checks the summary and their details, reviews the total price and the T&Cs, then confirms their obligation to pay. The order becomes final after FORRIDER's confirmation and collection of the amount due.
For a service on quote, the contract is formed after acceptance of the quote and the T&Cs, then full payment, unless a schedule is expressly provided. A quote is valid for thirty days, unless a different duration is stated on it.
Photo and video services are sold and paid for before they are performed. The date is only definitively reserved once the contract is formed and payment collected.
FORRIDER may refuse or cancel an order on legitimate grounds: unavailability, technical impossibility, payment incident, unlawful request, safety risk or abnormal quantity. Amounts collected for an order cancelled by FORRIDER are refunded, without prejudice to the Client's rights.
Product offers are valid within the limits of announced stock and capacity. In the event of unavailability, FORRIDER offers a new timeframe, an equivalent product accepted by the Client, or a refund.
The Client validates the spelling, colours, dimensions, visuals and instructions. An approved proof or summary binds the Client for the validated elements. A change requested after production has begun may be refused or entail a new price and timeframe.
The Client warrants that they hold the rights to the names, logos, designs and photographs provided for customisation.
Prices for consumers are shown in euros, all taxes included, according to the applicable regime. Delivery, travel, accommodation, rental, permit, parking and option costs are shown before validation or on the quote.
Professional prices are shown excluding tax and including tax where VAT applies.
The applicable price is the one accepted at the order. Any additional service is subject to a written agreement and supplementary invoicing.
Available payment methods are shown on the site or the quote. Products are payable in full at the order.
Photo and video services are payable in full at the order. Payment confirms the booking, subject to FORRIDER's acceptance. If a partial payment is exceptionally provided, it constitutes a deposit (acompte) and not earnest money (arrhes); the balance is payable on the quote date and at the latest before the session. Prior payment does not remove the legal right of withdrawal.
In the event of a payment incident, FORRIDER may suspend performance or delivery after informing the Client.
Any professional sum not paid when due bears, automatically and without reminder, penalties at the European Central Bank's most recent refinancing rate increased by ten points, and no less than the legal minimum.
A fixed indemnity of 40 euros for recovery costs is due for each invoice paid late. Additional compensation may be claimed on supporting documents if costs are higher. No discount is granted for early payment.
Zones, methods, costs and timeframes are shown before the order. The agreed date or timeframe appears in the confirmation. Failing that, the product is delivered without undue delay and at the latest thirty days after the contract is concluded.
In the event of delay, the Consumer may request performance within a reasonable additional period and, failing that, terminate the contract, unless the date was an essential condition.
For a Consumer, risk transfers when they take physical possession of the product, or when a third party designated by them (other than the carrier proposed by FORRIDER) takes possession. If the Consumer chooses a carrier not proposed by FORRIDER, risk transfers upon handover to that carrier.
The Client is invited to check the parcel and promptly report any damage to margaux@forrider.com, with useful photographs. This recommendation does not limit the legal guarantees.
FORRIDER retains ownership of the products until full payment, without altering the rules on transfer of risk to the Consumer.
The Client undertakes to:
FORRIDER does not provide custody or equestrian supervision of the horse. It may adapt or stop shooting if the safety of a person, animal or equipment is compromised. Where the situation results from a risk attributable to the Client, the part performed remains due and a rescheduling may be invoiced according to the costs actually incurred.
If the Client is late, the session may be shortened. If the delay makes it impossible, the situation is treated as a late cancellation, unless a legitimate reason is accepted.
Where weather, terrain, the health or behaviour of a horse, an organiser's decision, a drone ban or another condition compromises the expected safety or quality, the parties seek an adjustment or rescheduling. Sums paid are carried over to the new date. If no reasonable rescheduling is possible without fault of the parties, the services not performed are refunded, after deducting services performed and unrecoverable specific costs previously accepted.
Drone shots always depend on permissions, regulations, weather, environment and safety.
This article applies after expiry of the legal withdrawal period or where that period does not apply.
Any cancellation or rescheduling request is sent to margaux@forrider.com. The specific conditions and any indemnity are stated in the offer before the order. They take account of the time reserved, preparation, costs incurred and opportunities declined. Any manifestly excessive penalty may be reduced under legal conditions.
Specific costs already incurred and non-refundable, previously accepted, may be invoiced on supporting documents without double indemnification.
An accepted rescheduling is set according to FORRIDER's availability. In the event of a serious impediment on FORRIDER's side, it primarily offers a rescheduling. If no reasonable date is found, sums corresponding to services not performed are refunded.
Deliverables, formats, resolution, medium, gallery, access duration and timeframe are specified in the offer. The timeframe starts when FORRIDER has all the necessary elements and payments.
Delivery may take place via private gallery, download, transfer, physical medium or any agreed means. The Client downloads and backs up the files before the link expires.
Unless otherwise agreed, FORRIDER keeps a backup copy for six months after delivery, with no guarantee beyond. The Client remains responsible for their own backups.
The corrections included are those stated in the offer. Requests changing the brief, style, editing, duration or selection may be subject to an additional quote. An artistic choice does not by itself constitute a defect.
Music, fonts and third-party elements remain subject to their licences. A platform may limit, demonetise or remove content despite a valid licence; FORRIDER provides available supporting documents where permitted.
For a contract concluded at a distance or off-premises, the Consumer has fourteen days to withdraw without reason:

The Consumer exercises this right before the deadline via the appended form or any unambiguous statement sent to margaux@forrider.com or to FORRIDER, 46 chemin Baillarquet, 62780 Cucq, France.
For contracts concluded via an online interface, FORRIDER provides on www.forrider.com, during the legal period, a free, visible and easily accessible feature allowing withdrawal from the contract. An acknowledgement of receipt is sent on a durable medium.
The product is returned to FORRIDER, 46 chemin Baillarquet, 62780 Cucq, France, at the latest fourteen days after notification. Direct return costs are borne by the Consumer, except in case of error, non-conformity or contrary indication.
The Consumer handles the product only as necessary to check its nature and characteristics. They are liable for any depreciation resulting from excessive handling.
FORRIDER refunds payments received, including the initial standard delivery costs, at the latest fourteen days after being informed of the withdrawal. The refund may be deferred until the goods are recovered or proof of dispatch is provided. It uses the same means of payment, unless otherwise agreed, at no cost.
Payment or booking before performance does not amount to a request for early performance or a waiver.
If the session, an individualised preparation or another step must begin before the end of the period, FORRIDER obtains the Consumer's express request on a durable medium. If the Consumer withdraws after the start but before full performance, they pay the amount proportional to the service provided.
The right is lost for a service fully performed before the end of the period only if performance began at the Consumer's express request and after they acknowledged the loss of their right once the service was fully performed.
Where digital files without a physical medium are supplied before the end of the period, the Consumer only loses their right after expressly consenting to the early start, acknowledging the loss of their right and receiving confirmation of the contract. These choices are made via separate un-pre-ticked boxes or an equivalent writing.
The right of withdrawal does not apply, in particular, to:
These exceptions never remove the legal guarantees.
FORRIDER is liable for lack of conformity and hidden defects. Any request is sent to margaux@forrider.com or to 46 chemin Baillarquet, 62780 Cucq, France, with a description and useful elements.
The consumer has a two-year period from delivery of the goods to obtain the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer need only establish the existence of the lack of conformity, not the date it appeared. The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, at no cost and without major inconvenience. If the goods are repaired under the legal guarantee, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair but the seller imposes replacement, the legal guarantee is renewed for a period of two years from the replacement date. The consumer may obtain a price reduction while keeping the goods, or terminate the contract with a full refund against return of the goods, in the cases provided by law. These rights derive from articles L. 217-1 to L. 217-32 of the French Consumer Code. The consumer also benefits from the guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect.
The consumer has a two-year period from the supply of the digital content or service to obtain the legal guarantee of conformity in the event of a lack of conformity. During one year from supply, they need only establish the existence of the defect, not the date it appeared. It gives a right to be brought into conformity without undue delay, at no cost and without major inconvenience. The consumer may obtain a price reduction or terminate the contract if the professional refuses to bring into conformity, unduly delays it, imposes costs, causes major inconvenience or if the defect persists after an unsuccessful attempt. These rights derive from articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. The consumer also benefits from the guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect.
FORRIDER's photographs, videos, edits and creations remain protected. Ordering and payment do not automatically transfer copyright.
Unless a different licence is stated in the quote, the private Client receives, after payment, a personal, non-exclusive and non-transferable licence allowing them to keep the files, make private use of them and share them on their personal accounts without commercial use, keeping the signature and crediting FORRIDER where reasonably possible.
Any use by a brand, sponsor, media outlet, association, organiser or for commercial purposes requires written authorisation specifying the rights, media, purpose, territory, duration and price.
Without written agreement, it is prohibited to sell, assign, sub-license, deposit in a stock-image bank, use to train an artificial intelligence system, remove a signature or distort the work. Reasonable technical cropping by a platform is allowed.
The Client ensures that recorded persons have been informed and obtains the necessary permissions, in particular those of the legal representatives of minors.
FORRIDER does not publish the identifiable image of the Client or a participant on the sole basis of these T&Cs. Any promotional publication is subject to a separate, express, precise and optional authorisation. Refusing it does not prevent the order.
FORRIDER is liable for its obligations in accordance with applicable law. No clause limits the mandatory rights, legal guarantees or liabilities that cannot be excluded.
FORRIDER is not liable for damage resulting exclusively from the Client's fault, from use contrary to the intended purpose or instructions, from a third party, from an animal risk not reported or controlled, or from an event of force majeure.
If a technical failure attributable to FORRIDER causes the total loss of images before delivery, the Client may obtain a new service where possible, or a refund of the unperformed part, without prejudice to compensation for proven damage.
For a professional Client only, save gross or wilful misconduct, bodily injury or non-limitable liability, compensation for direct damage is capped at the pre-tax amount paid for the order concerned. Indirect losses, loss of business, turnover, data or opportunity are excluded to the extent permitted.
Force majeure is understood within the meaning of article 1218 of the French Civil Code. The affected obligations are suspended. If the impediment is permanent, the legal consequences apply, including the refund of services not performed.
FORRIDER processes the data necessary for enquiries, quotes, orders, payments, deliveries, sessions, after-sales service, accounting obligations and disputes. The legal bases are performance of the contract, legal obligation, legitimate interest or consent.
The recipients are FORRIDER and its necessary providers: payment, delivery, hosting, gallery, accounting and digital tools. Detailed information appears in the privacy policy available on www.forrider.com.
Anyone may, under the law, request access, rectification, erasure, restriction or portability of their data, object to certain processing and withdraw their consent for the future, by writing to margaux@forrider.com or to 46 chemin Baillarquet, 62780 Cucq, France. They may lodge a complaint with the CNIL.
Identifiable images are processed to perform the service. Their promotional publication is based on the separate authorisation provided in article 13.
Where a phone number is collected, the Consumer is informed of their right to register on Bloctel: www.bloctel.gouv.fr.

After a prior written complaint that has not been resolved, the Consumer may use, free of charge, the consumer mediator designated by FORRIDER:

The Client may also consult the European tool directing to alternative dispute resolution bodies: https://consumer-redress.ec.europa.eu/.
Mediation does not deprive the parties of their right to bring a matter before a court.
The consumer right of withdrawal does not apply to contracts concluded for professional purposes, subject to the legal extension for certain small professionals where article L. 221-3 of the French Consumer Code applies.
The professional is responsible for their brief, permissions, logos, music, credits and third-party rights. The professional licence must be described in the quote; no right not mentioned is assigned.
Delays in the Client's approval extend the delivery timeframes. FORRIDER may suspend the project after fifteen days without a response; resumption then depends on its availability.
Confirmations, quotes, emails, invoices, computerised records and payment data kept under reasonable conditions may serve as evidence, without preventing the Client from providing contrary evidence.
The applicable version is the one accepted at the order. FORRIDER may amend the T&Cs for future orders, without retroactive effect.
If a clause is void or unenforceable, the others remain in force. Not immediately exercising a right does not amount to a waiver.
The T&Cs and contracts are governed by French law, without depriving a foreign Consumer of more protective mandatory provisions.
Failing an amicable agreement or mediation, the dispute falls under the courts having jurisdiction according to ordinary law. The Consumer may in particular bring the matter before the courts having territorial jurisdiction under the Code of Civil Procedure, or that of the place where they resided at the time of the contract or of the harmful event.
